2. Scope of Application
These General Terms and Conditions (GTC) of G. Neuenschwander Söhne AG apply to all deliveries from MARAI. With your order on www.marai.ch or a purchase in the store you accept these GTC's between you and G. Neuenschwander Söhne AG.
3. Conclusion of Contract
When ordering within the online store on the website www.marai.ch of G. Neuenschwander Söhne AG, the customer submits a legally binding offer to conclude a contract. The contract is concluded by G. Neuenschwander Söhne AG accepting this offer through an order confirmation or by providing the goods for delivery. If delivery is not possible, the contract will be cancelled immediately. The customer will be informed about this immediately. If the customer has already paid, this amount will be refunded in full. If payment has not yet been made, the customer will be released from the obligation to pay. As a result of such a contract termination, G. Neuenschwander Söhne AG is not obliged to make any replacement delivery.
4. Prices and Value Added Tax
The prices are shown in Swiss francs, the currency converter also shows the prices in €, $ and £ (daily updated exchange rate). The statutory value added tax of 8.1% is included in the price.

As a means of payment we offer the following options: Credit cards (Visa, Master Card, American Express), Paypal. If you do not have a credit card or prefer to pay by bank transfer (prepayment/TWINT), please contact us by mail.
5. Delivery / Availability
We deliver to any desired address at home and abroad. If the delivery address is different from the billing address, the order will be delivered to the delivery address you specify. If the goods are delivered damaged or if the packaging suggests that the goods have been damaged, it is mandatory that this is noted upon receipt of the goods and that the type of damage is recorded, e.g. with a photo. Transport/shipping damage must be reported to G. Neuenschwander Söhne AG immediately. Deliveries will be made within 3-5 working days, unless otherwise stated in the offer of G. Neuenschwander Söhne AG. Please note that weekend and public holidays are added to this delivery period. Information on availability and delivery times are not binding unless confirmed in writing by G. Neuenschwander Söhne AG. In case of a delay in delivery of more than 30 days, the customer is entitled to withdraw from the contract.
6. Right of Return
The goods may be returned by arrangement within 14 days of receipt with the delivery note or invoice at the buyer's expense. The goods must be complete, in their original packaging and undamaged, otherwise no credit note will be issued.
7. Guarantee
The customer must report any obvious defects to G. Neuenschwander Söhne AG no later than 10 days after receiving the delivery. Hidden defects that are discovered later must be reported immediately upon discovery during the warranty period. Unless otherwise agreed, the warranty period for hidden defects is 24 months from the date of delivery.
A 24-month warranty period applies to material defects and manufacturing defects in hardware, zippers, and other functional components, effective from the date of purchase. The warranty applies exclusively to materials or workmanship that are demonstrably defective as delivered from the factory. Specifically excluded are normal wear and tear—including, among other things, age-related wear of zippers—as well as damage caused by improper handling or external influences.
The defective merchandise must be sent, along with a copy of the invoice, to the following business address: G. Neuenschwander Söhne AG, MARAI, Industriestrasse 4, 3672 Oberdiessbach. The customer is responsible for the return shipping costs. If defects are reported in a timely and proper manner, G. Neuenschwander Söhne AG will decide whether to replace or repair the item.
8. Applicable Law and Place of Jurisdiction
The business activities of G. Neuenschwander Söhne AG are based exclusively on Swiss law.
Place of jurisdiction is Bern.
